Terms and Conditions
The company CertiCycle (hereinafter referred to as the Company) is engaged in the creation, development, publishing, management, and operation of software applications. It specialises in developing solutions that make eco-friendly mobility accessible to as many people as possible.
Its Cyclope service, in particular, allows bicycles and scooters to be parked in a supervised area by an on-site attendant. This service is accessible via the website www.cyclope.cool, hereinafter referred to as the Website.
These Cyclope Terms of Use (hereinafter referred to as the General terms and conditions) apply to users utilising the website to park their bicycle or scooter and benefit from its services.
« Agent » : Refers to the trained and competent person engaged by Cyclope to welcome Clients and oversee the Vehicles. This person may be an employee of a security company partnered with Cyclope or work independently.
« Lock » : Refers to any device used to secure a Vehicle to the Structure, for which only the owner of the Vehicle holds the key or code to unlock it.
« Client » : Refers to the User who has subscribed to a Service.
«Cyclope » : Refers to the company CertiCycle, a Simplified Joint-Stock Company (Société par Actions Simplifiée) with a share capital of €15,000, registered with the Registre du Commerce et des Sociétés de Paris under number 900 215 955, with its head office located at 1 ter rue Marcel Paul - 95870 BEZONS
« Profile » : Refers to the page dedicated to a User registered on the Website, containing the information provided by that User.
« Services » : Refers to all the services offered by Cyclope, including reservation and parking, as well as any other service provided by Cyclope.
« Parking » : Refers to the equipment enabling the Parking of Vehicles.
« Structure » : Refers to the equipment enabling the Parking of Vehicles.
« User » : Refers to any person browsing the Website or using a Cyclope service, acting on their own behalf or on behalf of a legal entity, whether registered on the Website or not.
« Vehicle » : Refers to any bicycle or scooter owned by the User, which can be secured to a Structure using a Lock.
The User is subject to these General Terms and Conditions as soon as they are accepted upon accessing or registering on the Website, or by ticking the box indicating acceptance of the general terms and conditions of sale before confirming their Parking or reservation, and this continues until the deletion of their Profile, whether or not they make any Parking or reservations.
Cyclope reserves the right to modify its General Terms and Conditions at any time, without prior notice or the obligation to justify its decision, and without incurring any liability for doing so. In the event of a substantial change to any of the conditions within these General Terms and Conditions, Users who have previously accepted the terms will need to accept the new version of the General Terms and Conditions. The General Terms and Conditions in force are those applicable on the day of the User’s use of the Website.
To access the Services, the User must create a Profile by:
Cyclope Services only accept the following Vehicles:
Moped, even those that are electric, are not accepted.
The User may request the deletion of their Profile at any time by sending an email to Cyclope client service at contact@cyclope.cool.
The deletion of the Profile will only take effect once any ongoing transactions have been completed or once the reservation or Parking period for any other Service has ended.
The Client can reserve one or more Parking spots, subject to availability, at a fixed rate for a specified time slot, guaranteeing a space regardless of arrival or departure time (within opening hours).
To do this, the Client provides the desired Parking location, date, and the number of Vehicles. The reservation is only valid for the selected date and location.
As soon as possible, Cyclope confirms the Parking reservation and charges the Client the corresponding amount. The reservation can be cancelled or modified until the day of the Parking reservation. The amount for a cancelled reservation is then fully credited to the Client’s Profile.
The Client can initiate a Parking session for one or more Vehicles, subject to availability, without prior reservation.
To do this, the Client provides the name of the Parking location where they are and the number of Vehicles to park.
Once the Parking session is initiated, a timer starts measuring the duration of the Parking. Cyclope charges for the Parking time, based on the number of minutes elapsed multiplied by a price per minute, with every started minute being chargeable.
The Client places and secures their Vehicle on the Structure. They then start the Parking process on the Website, which includes: Logging in or registering, selecting the Parking location, taking a photo of each parked Vehicle, clicking Start Parking.
The Client understands and accepts that they must always secure their Vehicle to the Structure, despite the presence of on-site surveillance Agent. The Client also understands and accepts that Cyclope is not responsible for the loss, theft, or damage of any accessories left with the Vehicle during the Parking period.
Once the Parking session is initiated, the Agent is notified. Your Vehicle is considered entrusted to Cyclope only after the Agent has digitally confirmed the Parking details provided by the Client. The Agent may (but is not required to) place a wristband or other identifying marker on the Vehicle to physically confirm the Parking has been acknowledged.
The time elapsed since the start of the Parking session, as well as the remaining time before the Parking closes, is available on the Client’s Profile. The Client also receives an SMS alert 1 hour, 30 minutes, and 10 minutes before the Parking closes.At any time, the Client can send a message to the on-site Agent, who will respond as soon as possible.
To complete the Parking session, the Client must click End my parking and enter the code on the wristband that the Agent has attached to the Vehicle. This finalises the Parking duration and sends a notification to the Agent for confirmation. The Client can then remove their Lock and leave. They will receive a notification confirming the end of the Parking session, and for a session without prior reservation, they will be charged the corresponding amount for the duration of the Parking.
Cyclope Services are available only on the dates and times indicated on the Website. Cyclope reserves the right to change the opening dates and times at any time without notice. In such cases, the affected reservations will be cancelled, and the amount paid will be credited as a voucher to the client's Profile.
If the Client does not finish their Parking before the Service closes, the Vehicle will be removed from the Structure (potentially by cutting the Lock) and attached to a public facility with a new coded Lock. Cyclope will then send the exact location of the Vehicle, along with the code for the new Lock, to the Client through messages or email.
The Client understands and accepts the financial penalties resulting from this situation, corresponding to the cost of the new lock and the time spent by the Agent to complete this procedure. Furthermore, the Client understands and accepts that their old lock will not be returned, and no compensation will be provided.
The Client also understands and accepts that Cyclope cannot be held responsible for any theft or damage to the Vehicle once it has been attached to a public facility.
Cyclope reserves the right to cancel Services under any circumstances, even if reservations have already been made. In such cases, Cyclope will credit the Client's Profile with the amount debited during the reservation.
The price of the Services is paid by the Client in euros.
Payments are made by credit card. Accepted credit cards are: Visa, Mastercard, American Express. The credit card payment service is operated by Stripe. By paying with a credit card on the Website, Users accept Stripe's terms and conditions, detailed here.
Cyclope is in no way responsible for the actions or omissions of Stripe, and hereby disclaims any liability to the fullest extent permitted by law.
Cyclope cannot be held responsible for any fraudulent use of payment methods used by the Client. The Client guarantees that they are fully authorised to use the credit card for the payment of their order and that this payment method provides access to sufficient funds to cover all costs related to the purchase of Services.
Sustainable Mobility Card : The Client may also use their sustainable mobility card to pay for the Service if this functionality is available according to the provider of the mobility card.
Reservation of a Parking space: The Client is charged a fixed amount at the time of booking the Parking space.
Reservation of a Parking Space: The Client is charged at the end of the Parking session for the time spent on the Structure.
Other Services: The Client is charged at the time of subscribing to the requested Service for the corresponding amount.
In certain cases, the Profile may be credited with credits, particularly in the event of the cancellation of a reservation or the unavailability or cancellation of the Service by Cyclope.
The amount of these credits is available on the User's Profile.
The Client can use these credits to pay for all or part of future purchases, thereby reducing the amount of the transaction.
The Client has a right of withdrawal, which is set at fourteen calendar days from the subscription to a Service.
During this period, the Client must inform Cyclope of their decision to withdraw through a written and unambiguous statement or by using the withdrawal form included in the Annex. To exercise this right, the Client is not required to justify their reasons.
The User acknowledges and accepts that the Website is a digital service and that the Structures are mostly temporary installations in public spaces, meaning their operation may be affected or interrupted due to (i) malfunctions beyond Cyclope’s control, (ii) maintenance operations, or (iii) requests from its partners or the relevant administrative authorities.
The User acknowledges and accepts that the on-site Agents are primarily present to deter theft or damage but may also be subject to fraudulent behaviour, assault, or theft.Cyclope cannot be held liable for any negligence or fault on the part of the appointed Agent or any of Cyclope's partner companies.
The Agent's role is to actively monitor movements in the parking area. In particular, they watch for the following suspicious behaviours:
Cyclope cannot be held liable for matters outside of its control, including:
Cyclope cannot be held liable in any way for any direct or indirect damages suffered by the Client or
User in the use of the Website or Services, by the Agent in the course of their duties, or by its partners.
The Client understands and agrees that they must always secure their Vehicle to the Structure, despite the presence of an on-site Agent.
The Client is solely responsible for any damage to persons or property caused by their use of the Website, the Structure, or the Services.
In particular, the Client is required not to damage the Structure during its use or any other Vehicles present. In the event of damage to the Structure or other Vehicles occurring before, during, or after Parking, the Client will compensate Cyclope for the losses and costs incurred up to two hundred euros (200€), unless the loss or damage is attributable to a third party or a case of force majeure. The amount of compensation owed by the Client depends on the cost of the necessary repairs. Any breach of the Client's obligations under the General Terms and Conditions may result in exclusion from the Service. This provision does not exclude any other remedies Cyclope may have.
The rules applicable to the protection of personal data collected and processed in connection with the use of the Website and Services are described in Cyclope's Privacy Policy, freely accessible to any User or any person considering becoming a User.
The information collected constitutes the processing of personal data for the purpose of accessing the services offered by Cyclope, the data controller.In accordance with European data protection regulations, you have the right to access, modify, restrict, object to, or delete your personal data by contacting contact@cyclope.cool or by sending a postal letter to CERTICYCLE, 1ter rue Marcel Paul - 95870 BEZONS.
If any provision of these General Terms and Conditions conflicts with applicable law, or becomes, for any reason, partially or wholly invalid, the remaining provisions of the General Terms and Conditions shall remain valid.
The invalidity of one or more clauses of these General Terms and Conditions will not lead to the nullity of the said General Terms and Conditions.
The General Terms and Conditions are governed by French law.
The General Terms and Conditions are concluded for the duration of the User's registration on the Website.
Cyclope reserves the right to modify its General Terms and Conditions at any time, without prior notice or obligation to justify its decision and without incurring any liability as a result. In the event of a substantial change to one of the terms of these General Terms and Conditions, Users who have previously accepted their terms must accept the new version of the General Terms and Conditions. The applicable General Terms and Conditions are those in effect on the day of the User's use of the Website and/or the purchase of an item, depending on the nature of the modification made to the General Terms and Conditions.
Users who are considered consumers as per the preliminary article of the Code de la Consommation can freely resort to mediation for any contractual dispute, provided they have first lodged a complaint with Cyclope which did not resolve the dispute.
In accordance with Articles L.616-1 and R.616-1 of the Code de la Consommation, our company has set up a consumer mediation scheme. The mediation entity selected is: SAS CNPM -MÉDIATION - CONSOMMATION. In the event of a dispute, the consumer can submit their claim via the Website:

If no amicable solution is reached, Cyclope and the User agree to submit the dispute to the French courts. The terms of this article do not prevent consumers from initiating legal action or defending themselves in the country of their residence or domicile, nor from availing themselves of the protection measures provided for by the applicable law in their country of residence.
